The End of “Just Using AI”: Why Fannie Mae’s New Guidance Changes Everything

For the past two years, real estate professionals and loan officers have been told to “start using AI.”

Now, the question has changed.

Not whether you use it—but whether you understand how it is influencing your decisions.

In April 2026, Fannie Mae issued Lender Letter LL-2026-04, formally establishing a governance framework for the use of artificial intelligence and machine learning in mortgage origination and servicing. This is not a suggestion. It is a structural requirement for every institution that sells loans to or services loans on behalf of Fannie Mae.

The letter makes clear that AI is no longer treated as a peripheral tool. It is now a regulated component of the lending process, subject to the same scrutiny as any other decision-making mechanism that touches borrower outcomes.

The governance framework outlined in LL-2026-04 establishes seven core requirements for any institution deploying AI within the mortgage lifecycle:

  • Formal AI Policies and Procedures. Documented frameworks governing how AI tools are selected, deployed, monitored, and retired.
  • Transparency and Internal Communication. Clear internal documentation of where and how AI is used, accessible to compliance, management, and audit teams.
  • Ethical and Legal Compliance. AI systems must operate within the bounds of fair lending laws, fair housing requirements, and consumer protection regulations.
  • Active Risk Management. Ongoing identification, measurement, and mitigation of risks introduced by AI systems, including model drift and data quality degradation.
  • Defined Ownership and Accountability. Specific individuals or teams must be designated as responsible for AI governance, with clear lines of authority.
  • Vendor and Third-Party Oversight. AI tools sourced from third parties are subject to the same governance standards as internally developed systems.
  • Required Disclosure. Upon request, institutions must disclose their use of AI in processes that affect borrower outcomes.

Beneath the regulatory language lies a behavioral reality that researchers have already documented. In a preregistered study at The Wharton School, researchers identified a pattern they named cognitive surrender: the tendency to accept AI-generated outputs without critical evaluation.

When AI was correct, participant accuracy improved. When AI was wrong, accuracy dropped below what participants achieved with no AI access at all. Confidence, however, rose in both cases. Professionals became more certain and less accurate, and they did not recognize the gap.

This concept builds on prior analysis of how artificial intelligence is reshaping human judgment—where professionals are not just assisted by AI, but increasingly influenced by it in ways they do not fully examine.

This is not a technology issue. It is a behavioral shift—and one the industry has not yet fully accounted for.

This is the behavioral foundation that regulators are responding to. The risk is not that AI produces errors. The risk is that professionals stop noticing when it does.

The implications extend well beyond mortgage lending. Every real estate professional who uses AI is producing outputs that carry professional and legal weight:

  • Writing property descriptions that must comply with fair housing advertising standards
  • Explaining loan products to borrowers who rely on that information to make financial decisions
  • Responding to client questions with language that may constitute professional advice
  • Summarizing transaction details that become part of the contractual record

In each of these cases, AI is not simply assisting with a task. AI is now part of the decision itself—not just the process around it.

And this is exactly where regulation steps in.

The central risk is not technological failure. It is the assumption that responsibility can be delegated to a system that holds no license, carries no fiduciary duty, and faces no consequences.

The exposure is concrete. An AI-generated property description that includes language violating fair housing guidelines creates liability for the agent and the brokerage. A loan explanation that misrepresents terms creates liability for the originator and the institution. A client communication that contains inaccurate information creates liability for the professional who sent it.

In every case, the defense that “the AI wrote it” provides no legal protection. The professional who delivers the output owns the outcome.

What regulators, institutions, and professional standards bodies are collectively signaling is the end of passive AI use. The expectation moving forward is not that professionals stop using AI. It is that they use it with intention, structure, and accountability.

The standard is clear:

Understand it.

Verify it.

Own it.

A clear divide is emerging across the industry. Two distinct approaches to AI are becoming visible, and they carry very different risk profiles.
